1. Agreement to Terms
By accessing or using
www.ikagency.com (the “Website”) and purchasing any services from IKAgency, operated by Ihor Kirpichnikov (“IKAgency,” “I,” “me,” or “my”), you agree to be bound by these Terms of Service, our Privacy Policy, and our Refund Policy. If you do not agree to these terms, do not use the Website or purchase any services.
2. Services
IKAgency provides AI-powered product image processing services, including but not limited to:
- Studio-quality product photography with professional backgrounds
- Custom AI-generated backgrounds matched to your brand
- Lifestyle scene generation
- Product video creation (spin, ad, character, product videos)
- AI brand character creation
All deliverables are digital files (PNG, JPG, MP4) delivered electronically via secure download links.
3. Service Tiers and Pricing
IKAgency offers three service tiers: Starter, Growth, and Scale. Each tier includes a defined scope of work, number of images, and features as described on the pricing page at the time of purchase. Prices are listed in US Dollars (USD) and are subject to change without notice. Changes will not affect orders already placed.
4. Payments
All payments are processed securely through Paddle.com (“Paddle”), our authorized payment processor and Merchant of Record. By making a purchase, you also agree to Paddle’s terms of service. Paddle handles all payment processing, tax collection, and invoice generation on behalf of IKAgency. Accepted payment methods include major credit and debit cards, PayPal, Apple Pay, and Google Pay.
5. Delivery
Delivery timelines are estimates provided on the pricing page and depend on the selected tier and order complexity. I make every reasonable effort to meet the stated delivery window. Deliverables are provided via secure download links sent to the email address associated with your order. Download links remain active for 30 days after delivery.
6. Client Responsibilities
You are responsible for:
- Providing clear, high-resolution product images suitable for processing
- Ensuring you own or have the right to use all images submitted
- Providing accurate contact and payment information
- Reviewing deliverables promptly and communicating any issues within the revision window
7. Intellectual Property
Upon full payment, you receive a perpetual, non-exclusive, worldwide license to use the delivered images and videos for any commercial purpose, including but not limited to: e-commerce listings, advertising, social media, print materials, and packaging. IKAgency retains the right to use anonymized versions of deliverables in portfolio, marketing, and promotional materials unless you explicitly request otherwise in writing.
8. Acceptable Use
You may not use IKAgency’s services or deliverables for any illegal purpose, to create misleading or deceptive product representations, or to infringe on any third party’s intellectual property rights. I reserve the right to refuse service to anyone at my sole discretion.
9. Limitation of Liability
IKAgency’s total liability for any claim arising from the services shall not exceed the amount you paid for the specific order in question. In no event shall IKAgency be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
10. Disclaimer
AI-generated images are produced using advanced machine learning models. While I strive for the highest quality, results may vary based on the quality of source images provided. IKAgency does not guarantee specific sales outcomes or conversion improvements from the use of delivered images.
11. Governing Law
These Terms are governed by the laws of Ukraine. Any disputes arising from these Terms or the services provided shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of Ukraine.
12. International Customers
IKAgency serves customers worldwide, including the European Union, United Kingdom, United States, and other regions. If you are located in the EU, you may have additional rights under the General Data Protection Regulation (GDPR) and EU consumer protection laws. See our Privacy Policy for details on data handling.
13. Changes to Terms
I reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Website or services after changes constitutes acceptance of the revised Terms.
